These Terms apply to parkingtreeco.com and all services operated by ParkingTree.

1. Acceptance of Terms
By accessing or using ParkingTree's website, platform, or any related services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our website or services.
2. Description of Services
ParkingTree provides software tools for digital parking permit management on behalf of Property Operators.
ParkingTree does not:
- Independently determine or execute parking enforcement actions
- Tow vehicles or issue citations
All parking policies are determined solely by the applicable Property Operator.
3. User Responsibilities
By using ParkingTree's platform, you agree to:
- Provide accurate vehicle and license plate information at all times
- Keep your permit information current
- Comply with the parking rules established by the applicable Property Operator
- Maintain an active and valid permit for any vehicle parking in permit-required areas
- Not misuse, circumvent, or attempt to manipulate the platform
4. Enforcement Responsibility
ParkingTree is a software platform. All enforcement actions are the sole responsibility of the applicable Property Operator.
ParkingTree does not:
- Tow vehicles
- Issue citations or parking fines
- Make enforcement determinations
ParkingTree shall not be liable for any enforcement actions taken at a property using its platform.
5. Limitation of Liability
To the maximum extent permitted by applicable law, ParkingTree's total liability shall not exceed $300.
In no event shall ParkingTree be liable for:
- Indirect or consequential damages
- Lost profits or lost data
- Towing fees or vehicle storage charges
- Vehicle damage arising from towing or immobilization
6. Disclaimer of Warranties
ParkingTree's services are provided "as is" and "as available" without warranties of any kind.
ParkingTree makes no warranties regarding:
- Uninterrupted or error-free operation
- The accuracy or reliability of license plate recognition systems
- Specific enforcement outcomes
7. Indemnification
You agree to indemnify, defend, and hold harmless ParkingTree from claims arising out of:
- Incorrect or inaccurate information you provided
- Your violation of parking rules
- Your misuse of the platform
8. Dispute Resolution & Arbitration
Any dispute shall be resolved through binding arbitration administered in Maricopa County, Arizona.
Class Action Waiver: You waive any right to participate in a class action lawsuit or class-wide arbitration.
9. Governing Law
These Terms are governed by the laws of the State of Arizona. Legal actions not subject to arbitration shall be brought in Maricopa County, Arizona.
10. Modifications
ParkingTree may update these Terms at any time. When we make material changes, we will update the "Effective Date."
Continued use after modifications constitutes acceptance of the updated Terms.
